1. Acceptance of These Terms
These Terms and Conditions (the “Terms”) form an agreement between you and Specs On Site LLC (“Specs On Site,” “SOS,” “we,” “us,” or “our”). They govern your access to specsonsite.com and related pages, forms, communications, consultations, memberships, products, and services (collectively, the “Services”).
Additional terms displayed at checkout, on a product page, on a booking page, in a membership description, or in an incorporated policy are part of these Terms. If a clearly identified product- or service-specific term conflicts with these general Terms, the more specific term controls for that product or service, subject to applicable law.
2. Eligibility and Account Information
You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to make a purchase or enter into a paid agreement with us.
You agree to provide accurate, current, and complete contact, billing, shipping, prescription, and account information. You are responsible for safeguarding your login credentials and for activity conducted through your account.
3. Products, Pricing, and Orders
We make reasonable efforts to display product descriptions, colors, measurements, images, availability, and prices accurately. Screen settings, photography, supplier information, and manufacturing variations may affect how a product appears.
Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping charges, and other applicable charges are shown before you complete checkout when available.
We may correct errors, update information, limit quantities, reject suspected fraud, or cancel an order that cannot be fulfilled.
If Specs On Site cancels a paid order because the order cannot be fulfilled, the applicable paid amount will be refunded rather than converted into ordinary change-of-mind store credit.
Submitting an order is an offer to purchase. An automated order confirmation confirms receipt of the order and does not guarantee acceptance or product availability.
4. Prescriptions, Measurements, and Custom Lenses
When prescription products or lens services are offered, you are responsible for submitting a valid, accurate, and unexpired prescription issued by an authorized eye-care professional.
You are also responsible for reviewing the entered prescription, pupillary distance, frame size, lens options, and other measurements before approving the order.
We may contact you or the prescribing provider to clarify or verify information where permitted. We may pause or cancel an order if required information is missing, unclear, inconsistent, expired, or cannot be verified.
Custom prescription lenses and other personalized optical products are made specifically for the customer. Once customization or production has begun, those products are final sale for ordinary change-of-mind purposes.
This final-sale restriction does not eliminate any remedy that may apply when a product is defective, manufactured differently from the verified order, damaged in transit, fulfilled incorrectly by Specs On Site, or otherwise subject to rights that cannot legally be waived.
5. Shipping and Delivery
Shipping options, charges, and estimated delivery windows are displayed during checkout or communicated before fulfillment.
Delivery dates are estimates and may be affected by prescription verification, customization, product availability, carrier conditions, holidays, weather, address issues, and events outside our reasonable control.
You are responsible for providing a complete and deliverable address. Contact us promptly if you discover an address error. We cannot guarantee that an address can be changed after an order has entered fulfillment or shipped.
If a package arrives damaged, contains the wrong item, or appears incomplete, preserve the packaging and contact [email protected] promptly, preferably within 48 hours after delivery, with the order number and clear photos.
If we cannot ship an order within an applicable promised or legally required shipment period, we will provide the delay, cancellation, consent, and refund options required by applicable law.
6. Returns, Store Credit, and Refunds
Review the complete Return & Store Credit Policy before purchasing.
New frames and non-custom eyewear
Eligible new frames and non-custom eyewear may be returned within 14 calendar days after delivery.
To qualify, merchandise must be unused, undamaged, unaltered, and in its original condition and must include the original case, accessories, packaging, and other items supplied with the purchase.
Proof of purchase or another purchase-verification method accepted by Specs On Site is required.
Store credit only
Approved ordinary change-of-mind returns are issued as Specs On Site store credit only.
We do not provide refunds to the original payment method for ordinary preference, fit, style, or other change-of-mind returns.
Store credit issued for an approved return under our Return & Store Credit Policy does not expire and cannot be redeemed for cash except where required by law.
Return authorization
Before mailing a return, contact [email protected] with your order number and reason for the return.
Do not send merchandise back until Specs On Site has provided return instructions or authorization. Unauthorized returns may be delayed or rejected if we cannot identify the order or confirm eligibility.
Return shipping and original shipping charges
Customers are responsible for return shipping for ordinary change-of-mind returns.
Original shipping and delivery charges are not included in store credit for an ordinary change-of-mind return.
When a return results from an incorrect item, defective merchandise, a shipping or fulfillment error attributable to Specs On Site, or another circumstance in which Specs On Site is legally responsible, shipping and resolution will be handled separately as appropriate.
No restocking fee
Specs On Site does not currently charge a restocking fee for an eligible return made in accordance with the Return & Store Credit Policy.
Sale and promotional merchandise
Frames purchased during a sale, promotion, or with a discount remain eligible under the Return & Store Credit Policy unless the merchandise was clearly identified before purchase as Final Sale, No Returns, As Is, or similar language.
Custom and personalized products
Custom prescription lenses and other personalized optical products are final sale for ordinary change-of-mind purposes once customization or production has begun.
Products showing wear, scratches, alteration, misuse, missing parts, or customer-caused damage may be ineligible for an ordinary return.
Damaged, defective, or incorrect merchandise
Damaged, defective, or incorrectly fulfilled orders are handled separately from ordinary change-of-mind returns.
Depending on the circumstances, the resolution may include correction, replacement, store credit, prepaid return shipping, refund, or another remedy as required or permitted by applicable law.
Refunds required by law
The Store Credit Only policy does not replace a refund, cancellation right, warranty remedy, or consumer protection that cannot legally be waived.
Where applicable law requires a refund to the original payment method or another remedy, Specs On Site will follow that requirement.
Complete return policy
The complete requirements, exclusions, inspection rules, store-credit terms, shipping provisions, and other return conditions are contained in the Specs On Site Return & Store Credit Policy , which is incorporated into these Terms.
7. Eyewear Consultations
A one-time Zoom eyewear consultation is $50 for 30 minutes unless another price is displayed at booking.
When a consultation leads to a qualifying Specs On Site purchase, the $50 consultation fee is applied toward that purchase as described on the booking or offer page.
Consultations may include general help with frame selection, sizing, pupillary distance, measurements, prescription preparation, and product compatibility.
Booking, rescheduling, cancellation, attendance, and credit terms displayed on the applicable booking page also apply.
If consultation credit is applied toward merchandise that is later returned, the credit may be accounted for when calculating the resulting store-credit balance so that a return does not create duplicate credit or value.
9. Payments, Promotions, and Chargebacks
You authorize us and our payment processors to charge the amounts shown at checkout, including applicable taxes, shipping, and approved recurring membership charges.
We do not store full payment-card information when payment processing is handled by a third-party provider.
Promotional codes and promotional credits are subject to their stated conditions, may have expiration dates, have no cash value unless required by law, and may not be combined unless expressly permitted.
This does not apply to return store credit issued under the Specs On Site Return & Store Credit Policy. Approved return store credit does not expire.
Contact us first if you believe a charge is incorrect so we can investigate. This request does not limit any lawful billing-dispute rights you may have with your payment provider.
10. Acceptable Use and Intellectual Property
You may not use the Services to:
- Commit fraud, impersonate another person, or submit false information.
- Interfere with the website, security systems, payments, or another customer’s use.
- Copy, scrape, reproduce, resell, or exploit site content without written permission.
- Upload malicious code, infringing material, or unlawful content.
- Use the Services in violation of applicable law or another person’s rights.
The Specs On Site name, logos, page designs, copy, graphics, videos, and other original content are owned by Specs On Site LLC or used with permission and are protected by applicable law.
Product names and third-party trademarks belong to their respective owners.
11. Health and Vision-Care Disclaimer
Specs On Site provides eyewear guidance and retail support.
Unless expressly stated for a separately identified licensed service, Specs On Site does not perform eye examinations, diagnose or treat medical conditions, or replace care from an optometrist, ophthalmologist, optician acting within the scope of a license, or other qualified healthcare professional.
Consultation information is educational and product-oriented and is not medical advice.
Seek qualified professional care for eye pain, sudden vision changes, injury, infection, prescription concerns, or other health issues.
12. Service and Warranty Disclaimers
To the fullest extent permitted by law, the website and Services are provided on an “as available” basis.
We do not guarantee uninterrupted access, exact product availability, uninterrupted carrier service, or that every frame, lens, recommendation, or measurement method will be suitable for every person.
Manufacturer warranties, if any, are governed by the applicable manufacturer’s terms.
We do not disclaim warranties or consumer rights that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, Specs On Site LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services, including lost profits, lost data, or loss of use.
To the fullest extent permitted by law, our aggregate liability for a claim relating to a product, consultation, membership, or transaction will not exceed the amount you paid to Specs On Site for the product or service giving rise to that claim during the 12 months before the event.
These limits do not apply where prohibited by law or to liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Specs On Site LLC harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person’s rights, or submission of false or unauthorized information.
This section does not require you to indemnify us for our own unlawful conduct.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where the mandatory law of your home jurisdiction applies.
Before filing a legal claim, you and Specs On Site agree to make a good-faith effort to resolve the issue by contacting the other party and allowing a reasonable opportunity to respond.
Unless applicable law requires otherwise, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts located in New York County, New York.
Nothing in this section prevents either party from using an eligible small-claims court or exercising a right that cannot legally be waived.
16. Changes, Suspension, and General Terms
We may update these Terms to reflect changes in our Services, business practices, or legal obligations.
The updated version will be posted with a revised “Last updated” date. When required, we will provide additional notice or request renewed consent.
Unless otherwise required by law, changes to the Return & Store Credit Policy apply prospectively and do not reduce the return rights disclosed for a purchase already completed before the policy change became effective.
We may suspend or terminate access for fraud, unlawful activity, abuse, nonpayment, security risk, or material violation of these Terms.
Provisions that logically should survive termination will remain in effect, including payment obligations, intellectual-property provisions, disclaimers, liability limits, indemnification, and governing-law provisions.
If any provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver.
These Terms, together with incorporated policies and specific checkout disclosures, form the agreement between you and Specs On Site concerning the Services.
